Terms of Use

1. Acceptance of Terms

By accessing or using the Permalive dashboard or managed 24/7 channel service at permalive.stream (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Permalive is a platform for running 24/7 live channels from a YouTube library. The Service supports streaming to Twitch, Kick, YouTube Live, and any destination that accepts RTMP input. The Service is offered in two tiers:

  • Free tier: a self-serve dashboard where you connect your streaming platform and YouTube accounts, import playlists, design queues with sources and exclusions, assign per-playlist categories, and invite team members. The free tier does not broadcast — your queue lives in the dashboard until you upgrade.
  • Managed 24/7 channel tier: a managed service where we run your 247 channel on our infrastructure. This tier is provisioned by contacting us at contact@permalive.stream, and pricing is negotiated individually based on your channel, bandwidth, and onboarding needs.

3. Eligibility

You must have a valid account on the streaming platform you intend to use (e.g., Twitch, Kick, YouTube). You must meet that platform's minimum age requirements and comply with its terms of service at all times. You are responsible for maintaining the security of your streaming platform and YouTube accounts.

4. Accounts and Authentication

Permalive currently uses Twitch OAuth for dashboard authentication and YouTube OAuth for playlist access. Additional sign-in methods may be added in the future. We do not create separate accounts or store passwords. You may disconnect either platform at any time through the dashboard, which revokes our access.

For 247 channels, we strongly recommend creating a dedicated secondary account on your streaming platform (e.g., yourhandle247) rather than using your main account. This is a recommendation, not a requirement.

5. Content Ownership and Rights

You retain all ownership of the content you stream through Permalive, including your YouTube videos, playlists, titles, thumbnails, and metadata. By using the Service, you grant us a non-exclusive license to access, process, and rebroadcast your content to your chosen streaming platform solely for the purpose of providing the Service to you.

You are solely responsible for ensuring you have the right to stream the content in your queue.You must own the content, have a license to broadcast it, or otherwise have the legal right to stream it on your chosen platform. You represent and warrant that your queue content does not infringe any third party's rights, including copyright, trademark, publicity, or privacy rights.

6. Acceptable Use

You agree not to:

  • Stream content you do not own or have the right to broadcast, including copyrighted music, video, or other material for which you lack a license
  • Use the Service to violate the terms of service, community guidelines, or DMCA obligations of your streaming platform
  • Stream content that is illegal, harassing, hateful, obscene, defamatory, or otherwise prohibited by your streaming platform
  • Attempt to interfere with, disrupt, or reverse-engineer the Service, dashboard, or encoding infrastructure
  • Use the Service to send spam, engage in view-botting, or manipulate platform metrics
  • Share your dashboard access with unauthorized third parties (use team invitations instead)
  • Resell, sublicense, or white-label the Service without our written permission

7. DMCA and Copyright

Permalive does not strip audio or otherwise modify your video content before streaming. If your YouTube videos contain copyrighted material you do not have the right to broadcast, that content will also appear on your live stream, and you may receive DMCA takedowns from your streaming platform. You are solely responsible for the copyright status of everything in your queue.

If we receive a valid DMCA takedown notice for content streamed through Permalive, we will remove the offending content from your queue and notify you. Repeat infringement may result in suspension or termination of your account.

8. Managed Tier Service

The managed 24/7 channel tier is provisioned on a per-customer basis after contacting us. We reserve the right to decline managed tier service at our discretion, including based on content category, infrastructure capacity, or risk assessment. Managed tier pricing, billing terms, and service parameters are agreed individually and are not governed by these Terms alone — any written agreement we enter into for managed service supplements these Terms.

We aim for high uptime on the managed tier and operate with self-healing stream recovery, but we do not guarantee a specific service-level commitment unless explicitly stated in a separate written agreement.

9. Availability and Changes

We may modify, suspend, or discontinue the Service at any time with or without notice. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We are not liable for any downtime, service interruptions, or data loss except to the extent required by applicable law.

10. Intellectual Property

The Service, including all dashboard code, infrastructure, designs, trademarks ("Permalive", the permalive.stream domain, and associated branding), and documentation, is owned by us. Nothing in these Terms grants you any right to our trademarks, code, or designs except the limited right to use the Service as intended.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

12. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost viewers, lost subscribers, reputational harm, or platform suspensions arising from your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars if you are on the free tier.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third party's rights — including, without limitation, claims brought by streaming platforms, copyright holders, or other creators whose content appears in your queue without authorization.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, for failure to pay (managed tier), for repeated DMCA takedowns, or for any other reason. You may stop using the Service and request account deletion at any time by emailing contact@permalive.stream. Upon termination, your right to use the Service ceases immediately; sections related to content ownership, intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

15. Governing Law

These Terms and any disputes arising from them are governed by the laws of Sweden, without regard to conflict-of-law provisions. Any dispute shall be resolved in the competent courts of Sweden, except where mandatory consumer-protection laws in your jurisdiction provide otherwise.
